These Terms of Service ("Terms") govern your use of the Perciva platform ("Service"). By using the Service, you agree to these Terms.

1. Service Description

Perciva is a SaaS platform that monitors your brand visibility across AI platforms (ChatGPT, Perplexity, Google AI Overviews, etc.). The Service includes AI response tracking, competitor analysis, citation monitoring, and reporting features.

2. Account Creation

You must create an account with a valid email address to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You are liable for all activities that occur under your account.

3. Subscription and Billing

  • Paid plans are billed monthly or annually.
  • After the free trial period, your account automatically converts to a paid plan.
  • Cancellations take effect at the end of the current billing cycle.
  • Refund policy: Full refund within the first 7 days for annual plans.

4. Acceptable Use

By using the Service, you agree to:

  • Comply with all applicable laws and regulations
  • Not use the Service for malicious purposes (spam, scraping, DDoS, etc.)
  • Not interfere with other users' access to the Service
  • Not exceed API usage limits

5. Intellectual Property

The Perciva platform, interface, logos, and content are owned by the company. You retain all rights to data you upload. You have commercial usage rights for reports and analyses generated through the Service.

7. Service Level

We target 99.9% monthly uptime. Advance notice will be provided for scheduled maintenance. Affected time during service outages will be credited to your subscription.

8. Limitation of Liability

Perciva is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the total amount you paid in the last 12 months. The Service is provided "as is" without warranty of fitness for a particular purpose.

9. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate your account for violation of these Terms. Your data remains accessible for 30 days after termination.

10. Changes

We reserve the right to modify these Terms with prior notice. You will be notified via email 30 days in advance of significant changes.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved in the courts of Delaware.
